If you are considering separating from your spouse, it is always a good idea to have a lawyer review your situation and provide accurate advice.  California divorce and family law is complex.   Brown & Lipinsky, Attorneys at Law has handled hundreds of cases related to separation and divorce in Pomona, Chino Hills, Riverside, Ontario, Palm Springs, and the entire Inland Empire region of Southern California.

Knowing the difference between divorce and legal separation

Legal separation occurs when a married couple receives a court decree that recognizes the couple is no longer living together. This judgment order is often an initial step towards divorce.   Sometimes the legal separation decree completes the divorce case.  According to California law, you must petition the court to be legally separated.  An attorney can help you understand which separation or divorce option is right for your situation.  Our law firm has provided separation and divorce advice for couples throughout the Inland Empire region—including couples in Pomona, Chino Hills, Riveside, Ontario, and other communities.

A legal separation is an agreement the parties involved do not wish to terminate the bond of marriage, but still want to formally separate.  One reason to not to end the marriage is medical insurance eligibility.  The agreement dictates custody, support and visitation of any children.  Just like a divorce, spousal support, property and asset division issues are addressed as well.

Unlike divorce, separation  leaves the contract of marriage in place.  However the couple is married in “name only” and the rights and responsibilities of a “normal” marriage do not apply.

California separations need skilled counsel

Physical separation is different than legal separation. If you are separating, you should contact an attorney and

  • Maintain open communications with your spouse and your children as much as possible.
  • Seek legal, financial and personal assistance from appropriate professionals

Be aware that communications with certain professionals, such as accountants, may not be bound to client privilege.  Attorneys are bound by client privilege.  They work and advise with your best interests in mind.
